HUD Withdraws 14 Office of General Counsel Guidance Documents

Published July 22, 2026

14 Office of General Counsel (OGC) guidance documents address[ed] a range of fair housing, civil rights, and federally assisted housing issues. Although the notice was published on July 17, 2026, HUD states that the withdrawals were effective September 25, 2025. According to the Department, this is part of HUD’s broader regulatory reform efforts and review of sub-regulatory guidance. 

HUD Publishes New NSPIRE for Vouchers Administrative Notice

NAHRO Submits Comments on OMB Proposed Rule on Federal Financial Assistance

NAHRO’s primary request in its comment letter was for OMB to withdraw the proposed rule as it would produce erratic and unreliable funding streams that would disrupt the provision of federal rental assistance, lower or eliminate the provision of new affordable housing, and increase rental and homeownership prices across the country. 

HUD Publishes Guidance for the Melania Trump Foster Youth to Independence Initiative

Published July 27, 2026

Notice PIH 2026-19, provides guidance for public housing agencies (PHAs) in requesting targeted vouchers under the Melania Trump Foster Youth to Independence Initiative. This notice supersedes Notice PIH 2023-04 and includes [eight] changes.

HUD Corrects Administrative Fee Proration Estimate for August 2026 in Email to Housing Agencies

The Department has corrected the error and new revised enclosures for the program will be sent to housing agencies within the next few days. At this time HUD estimates an administrative fee proration of 86% for calendar year 2026.

HUD Issues Guidance Requiring Report of Cyber Incidents

Published August 10, 2026

When PHAs experience a cyber incident, they must notify HUD within 36 hours of becoming aware of the incident and should also contact law enforcement. The notice provides specific guidance on [a few] topics.

NAHRO Joins Partner Organizations in Commenting on BABA Request for Information

Published August 10, 2026

The letter’s comments focused on reiterating the difficulties BABA creates for housing construction, maintenance, alteration, and repair and provides several practical improvements to BABA’s implementation, including suspending BABA requirements during this study and issuing updated information based upon its results.

Court Requires HUD to Vacate Issuance of FY 26 CoC NOFO

The court determined that HUD violated the law by not providing a public notice-and-comment period when making changes to the NOFO in deemphasizing its Housing First approach through the use of its $1.3 billion set aside for transitional housing. This now means that HUD will have to start the NOFO process from the beginning, issuing another NOFO for applicants to apply.

HUD Publishes Notice Removing Certain Payment Standard Flexibilities for EHVs and SVs

Housing agencies must follow the regulations at 24 CFR 982.503(c) on the payment standard basic range and 24 CFR 982.503(d) for instances where an exception payment standard may be set to an amount higher than 110% of the FMR.

NAHRO Submits Comments on Proposed Methodological Changes to 2026 HCV Renewal Funding Inflation Factors

NAHRO suggested that HUD take the following course of action: Use the methodology HUD used in FY 2023 to calculate RFIFs for FY 2027; make no changes to RFIFs in FY 2026 using an additional factor; not adjust RFIFs in 2027 based on a factor that would discount or mark up RFIFs based on a local jurisdiction’s policies that impact housing supply; and if considering making adjustments to individual RFIFs in FY 2027, look at factors that may add costs to the operation of a voucher program and apply a markup to the RFIF for those agencies.

HUD and Other Federal Agencies Launch “Treatment First” Toolkit

The toolkit aims to emphasize the administration’s move away from the “Housing First” model … prioritiz[ing] approaches that focus specifically on addressing substance use disorders among people experiencing homelessness.
