July 21, 2026 — On July 10, HUD published the proposed rule titled “Rescission of Floodplain Management and Protection of Wetlands; Minimum Property Standards for Flood Hazard Exposure; Building to the Federal Flood Risk Management Standard,” which would rescind and replace HUD’s regulations governing floodplain management and the protection of wetlands.

The proposed rule would put back into place HUD regulations as they existed before the April 23, 2024, final rule. However, the proposed rule does maintain flexibilities from the final rule related to floodways, categorical exclusions, exemptions from Part 55 applicability, and the decision making process; it also proposes minor revisions for clarity.

Public comments on the proposed rule are due by September 8, 2026.
