HUD Updates HOTMA Implementation Guidance

HUD issued updates to Notice PIH 2023-27/H 2023-10, shortly after the release of Notice PIH 2026-09/H 2026-05. Together, thy clarify requirements for interim reexaminations and make several technical and policy adjustments to existing HOTMA guidance. 

NAHRO Submits Comment Letter on 2026 Proposed Rule on Mixed-Status Families

The comment letter articulated NAHRO’s three-tiered position on the proposed rule which stated that HUD should take one of the following three steps:

  1. Make no changes to the current eligible status verification regulations;
  2. If unwilling to follow the first recommendation, then restrict application of the new rule to new applicants of covered programs; and
  3. If unwilling to follow either of the first two recommendations, then take the steps and adopt the recommendations in NAHRO’s comment letter before implementing the proposed rule.

NAHRO Submits Comments on the Revocation of the 30-Day Notification Requirement

NAHRO emphasizes support for the revocation citing past comments to the proposed rule published in 2023. The 30-day notification requirement, while well intentioned, has several potential negative impacts including legal confusion in states and localities; increasing the financial burden on PHAs; and long-term impacts on tenants facing eviction or prospective tenants on a waiting list.

HUD Releases Two Notices Related to HOME Program Requirements

After over a year of regulatory review of the HOME final rule, HUD is proposing several changes in their notice FR-6144-P-09. Most notably, HUD is proposing to revert to tenant protections as they existed prior to the 2025 final rule. In Notice FR-6144-F-08, HUD indefinitely delays any requirements in the HOME final rule that are not yet in effect.

HUD Publishes Proposed Rule on Equal Access to Housing Replacing References of Gender

The Department highlights in the proposed rule that this change “…would ensure that equal access to qualifying facilities would be provided in accordance with the sex of an individual based on his or her immutable biological classification as either male or female rather than the ever-shifting concept of self-assessed gender identity.”

FY 2025 CoC Awards for Quarter Two Announced

HUD announced more than $1.095 billion in fiscal year 2025 Continuum of Care (CoC) program renewal funding for quarter two. The awards will fund 1,826 projects meant to prevent and reduce homelessness.

HUD Publishes FY 2026 HCV Funding Notice

PIH Notice 2026-12 implements the Housing Choice Voucher (HCV) funding provisions of the Fiscal Year (FY) 2026 appropriations bill.

HUD Sends New EIV-SAVE Tenant Matching Report Guidance to PHAs and Publishes EIV-SAVE FAQ

The email states that HUD has refreshed the EIV-SAVE Tenant Matching Report; HUD will require that housing agencies “attest” that they have reviewed the report and verified eligibility; and that HUD has published a frequently asked questions document on the EIV-SAVE Tenant Matching Report.

HUD Opens Application Process for Additional MTW Expansion Agency

Notice PIH 2026-13 opens the application process for one final available spot in the Moving to Work (MTW) Expansion’s “Flexibility II” cohort. Eligible small public housing agencies, (PHAs) with 1,000 or fewer combined public housing and Housing Choice Voucher units, can apply for participation.

HUD Publishes Guidance on Deceased Tenants Report

The notice provides both general and program specific guidance on how housing agencies must monitor the Deceased Tenants Report in the Enterprise Income Verification (EIV) system to take appropriate action when individuals are determined to be deceased. It notes when unit tenant status must be adjusted and what housing agencies should do when overpayments are adjusted.

NAHRO Submits Comments on HUD’s Proposed Term Limits and Work Requirements Rule

NAHRO’s comments emphasized the importance of implementation being optional for all agencies. Whether these policies will be feasible for local communities will vary by agency, as will agencies’ ability to provide the supportive services required in the rule with no additional funding.
