July 21, 2026 — On June 29, 2026, NAHRO submitted comments in the proposed rule titled “Equal Access to Housing in HUD Programs Revisions.”

The proposed rule, if implemented, would remove prohibitions on service providers from seeking information to confirm the sex of applicants. This would preempt any conflicting state or local laws, non-compliance, and violations of said requirements to be subject to applicable penalties, including loss of federal funding. Additionally, it would remove references to “gender” and “gender identity” from HUD regulations or replace them with “sex.”

In comments written to HUD, NAHRO warns that the proposed changes have the potential to create a number of negative impacts that will result in the displacement of individuals experiencing or at risk of homelessness.

NAHRO opposes any effort that would create discriminatory barriers preventing individuals from housing and or shelter and cause future homelessness.
