HUD Sends Letter on HCV Budget Management; Expects Large Shortfalls Despite 99% HAP Proration

HUD sent a letter via email to housing agency executive directors discussing Housing Choice Voucher (HCV) …. timelines, Housing Assistance Payments (HAP) prorations, offsets, and provides recommendations for housing agencies on how to manage their budgets. The letter notes that though HUD is expecting a 99% HAP proration, housing agencies should take measures now to reduce program costs to ensure that an agency’s funding meets its anticipated expenditure needs.

We Need More Homes, Not More Rules

Secretary Scott Turner argues in his recent Washington Post op-ed that HUD’s proposed rule on Verification of Eligible Status (2026-03405) will “redirect $218 million to American families” and restore integrity to housing programs. But a careful reading of Section 214 of the Housing and Community Development Act of 1980 and of HUD’s own proposal shows that this rule risks collateral damage to the very Americans it claims to help and the agencies doing the work to home them.

New 2026 HUD Mixed-Status Proposed Rule Makes Major Changes

HUD published a proposed rule titled “Housing and Community Development Act of 1980: Verification of Eligible Status.” The proposed rule, if finalized, would require certain entities that administer federal rental assistance, including housing agencies, to impose stricter requirements on families composed of both people who have documentation of citizenship and eligible immigration status and people who lack that documentation (i.e., mixed-status families).

HUD published a proposed rule titled “Establishing Flexibility for Implementation of Work Requirements and Term Limits” in the Federal Register. The proposed rule would provide agencies with the flexibility to implement term limits, work requirements, both, or neither.

HUD Publishes Notice on Implementation of Reduced Elevated Blood Lead Levels

Posted March 5, 2026

HUD published the notice titled “Implementation of the Reduced Elevated Blood Lead Level Triggering Response in Certain Assisted Target Housing,” which modifies the elevated blood lead level (EBLL) threshold for children under six years old … the EBLL threshold, which is used to monitor safety of blood lead levels in children, has been changed from 5 to 3.5 micrograms of lead per deciliter of blood (µg/dL) for children under six years old.

Two New HUD Notices Rescind Flexibilities for HCVs, Public Housing, EHVs, and Stability Vouchers

HUD published two notices: “Rescission of Notice PIH 2024-17” (Notice PIH 2026-04), and “Revision to Emergency Housing Voucher and Stability Voucher Program” (Notice PIH 2026-05). The collective effect of both notices is to rescind flexibilities that HUD had accorded to housing agencies in administering these programs.

HUD Sends Update on EIV-SAVE Report

HUD sent an email to PHA executive directors providing additional information and guidance on HUD’s recent Enterprise Income Verification Systematic Alien Verification for Entitlements (EIV-SAVE) report …. It includes language that clarifies the earlier guidance letter. It also notes that an additional frequently asked questions (FAQ) document will be published in March that will answer additional questions.

HUD Delays Effective Date of 30-Day Notification Requirement Prior to Termination of Lease for Nonpayment of Rent

A pre-publication copy of a notice titled “Revocation of the 30-Day notification Requirement Prior to Termination of Lease for Nonpayment of Rent; Indefinite Delay of Effective Date” was published in the Federal Register. The notice changes the effective date of the previously published interim final rule that eliminated the 30-day notice requirement for nonpayment of rent on March 30, 2026 …. the new effective date is delayed indefinitely pending consideration of public comments received.

HUD Publishes Public Housing Cash Management Frequently Asked Questions

HUD published a Frequently Asked Questions (FAQ) document on new cash management requirements for public housing and mixed finance developments. In 2024 and 2025, HUD released a series of notices changing the way PHAs use and document Public Housing Operating Fund subsidy: PIH Notice 2024-25, PIH Notice 2025-20, and PIH Notice 2025-22.
